Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Agent Refinery service at agentrefinery.ai (the “Service”), provided by Agent Refinery LLC (“Agent Refinery,” “we,” “us”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for complying with all laws applicable to your use.
2. The Service
Agent Refinery analyzes friction signals from your AI coding sessions locally, uploads distilled insight candidates, and provides a collaborative board for your team to review, vote on, and apply them to your project's configuration. The Service is offered as an early-stage product and may change, and features may be added or removed, over time.
3. Accounts and devices
You are responsible for the security of your account, your sign-in credentials, and any device tokens you create. Keep device tokens secret; you are responsible for activity that occurs under your account or tokens. Notify us promptly of any unauthorized use.
4. Your data and content
You retain all rights to the content you and your organization submit through the Service (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service. You represent that you have the necessary rights and, where applicable, the consent of your teammates to submit Your Content, and that doing so does not violate any law or third-party right. Our handling of Your Content is described in our Privacy Policy.
5. Acceptable use
You agree not to:
- Use the Service in violation of any law or third-party right.
- Attempt to gain unauthorized access to the Service, other organizations' data, or our systems.
- Interfere with, disrupt, or place undue load on the Service.
- Submit content you do not have the right to submit, or that contains malware.
- Resell or commercially exploit the Service except as expressly permitted.
6. Third-party services
The Service relies on third-party services, including Google for sign-in and the Anthropic API for processing. Your use of those services is subject to their respective terms, and you are responsible for any API keys or accounts you supply. We are not responsible for third-party services.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that insights it surfaces will be accurate or suitable for any purpose. You are responsible for reviewing any changes before applying them to your projects.
8. Limitation of liability
To the maximum extent permitted by law, Agent Refinery will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim or one hundred U.S. dollars (US$100).
9. Indemnification
You agree to indemnify and hold harmless Agent Refinery from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in Delaware will have exclusive jurisdiction over any dispute arising from these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
